Report: Federal Judge Could Halt Implementation of ObamaCare This Week…
Christmas coming early?
(Politico) — U.S. District Judge Roger Vinson has already dealt the Obama administration a staggering blow on health reform, and this week the administration may get another one from the fiery Florida judge.
The Justice Department asked Vinson to clarify his ruling that struck down the law as unconstitutional. Justice must file its brief on the motion by Monday, and Vinson has said he would rule quickly after that. At issue is whether Vinson meant to stop reform implementation in the 26 states that brought the suit.
The smart money says Vinson will halt implementation, and legal observers are wondering why Justice would take that risk.
“Having lost one game of chicken when it came to the severability of the mandate, the government is now challenging the same judge to back down on whether his decision is binding. Seems like a risky move,” said Randy Barnett, a law professor at Georgetown University.

This has to be a first a Federal judge having to re-clarify a ruling of his when he implicitly said the law was null and void.
I was born at night but I wasn’t born last night and I know we have a bunch of fricking idiots in charge of the asylum.
If “obamascare” is ever implemented this country is done. It must be completely dismantled, start over with conservative input. obama must be defeated in 2012 or America is in for real trouble. Pawlenty -West is a good ticket. May not be best but can win against the billion dollar campaign machine of the socialist left. America must not allow the left to decide who runs as was the case in 2008
Levin has been talking about this quite a bit. The ruling left no doubt as to what the judge wants. He stated in his opinion that an injunction is unnecessary because the ruling views the whole statute as unconstitutional. He can probably cut/paste from his original ruling.

I think the filing of the brief is stall tactic on the part of the admin.
They waited three weeks to file it, why?
They know they couldnt file an injunction because they would have to prove that they would have a better than likely chance they would win in a higher court. I dont think they wanted to go that route
I think its a case of implement and buy time. Once its in place they think folks wont want to get rid of the law
Obama will not follow Vinson’s ruling, whatever it is. They’ll ignore it and ask for an emergency stay and/or have him removed from the case. In any event, they’ll keep kicking the can and daring Congress to impeach anyone. To them, it’s a win-win: either they get to ignore the courts (whoops, already doing that) or they get to re-engage class warfare, racial warfare, etc. To Obama, where’s the downside.

Because they are stupid? They do not know how the government works, so they think they can do what they want? Because they know they are toast and they are trying to have one last Battle of the Bulge?
My bet is that they call his hand. He says, “Not only NO, but Hell NO.” They may try some weird stuff. Next they risk the SCOTUS preferring not to hear the case and let Vinson’s ruling stand.
Another judge told Obama to start issuing drilling permits. How is this any different? Obama is above the law.

I pray that Judge Vinson has good security. The real target of the Tucson shooting was the Republican judge, who, if you notice, is never mentioned. (The media has been playing its part in pushing to drop federal charges by promoting the lie that he just stopped by to say hello, and not discuss a point of law with Giffords.)

obarky is just trying to delay – he has ignored two other rulings on the oil drilling ban; so he will ignore this one too. He seems to be pretty comfortable that no one has the guts to start impeachment hearings against him. I don’t think the judge needs to watch his back – obama is delaying just to get something else done. I wish I knew what it was.

The fact that they would do this, when the outcome APPEARS to be obvious, makes me suspicious that they have a trick up their sleeve that we arent counting on. Perhaps another lawbreaking maneuver- this is probably just more smoke and mirrors.
I cant believe everyone still assumes they would follow the rules, or even the law if in the way of accomplishing their agenda. They have no respect for prudence, they have no respect for the people of this country- they intend to destroy this country from the inside out.
Impeachment proceedings would be abundant if this administration existed 30 years ago. It has become more than obvious that they aren’t simply as ignorant as they appear, when given the benefit of doubt. They intend to destroy America. Case closed.
Obama will NOT be impeached. You need both the House and the Senate to Rule that he be impeached. The Senate is comprised of mostly Democrats and RINOs that support everything Obama is doing. I guess they will get a BIG payoff when Obama is done killing the country. Communism infiltrated this country almost 100 years ago. Obama was Hired to put the Final Nail in the Coffin of America.
