Good Grief: Clyburn Cites Emancipation Proclamation, Civil Rights Victories As Evidence Obama Should Invoke 14th Amendment To Raise Debt Ceiling…

For those of you keeping track at home, this is the second time in two days Clyburn has urged Obama to invoke the 14th Amendment.

(Politico) — Rep. Jim Clyburn (D-S.C.) cited major civil rights victories as examples of successful presidential executive orders as evidence President Barack Obama should invoke the 14th Amendment to raise the debt ceiling if Congress fails to do so.

“He could do that [an executive order] with a stroke of a pen. We have seen many big things done in history that way,” Clyburn said on MSNBC’s “Jansing & Co.” “I was joking to my staff the other day: ‘Tell me the bill number for the Emancipation Proclamation.’ It was an executive order. We integrated the armed services by executive order. We integrated the public schools by executive order. Sometimes executives must order that things get done.”

Clyburn added, “If the president gets up to Aug. 2 without a piece of legislation, he shoud not allow this country to go into default. He should sign an executive order invoking the 14th Amendment and send that to all the governmental agencies for us to continue to pay our bills.”

Obama administration officials, and the president himself, have said they will not invoke the 14th Amendment. And Clyburn’s remarks came after some tea party Republicans, in particular Rep. Steve King (R-Iowa), said Obama should be impeached if he were to use the 14th Amendment to raise the debt ceiling.

This moron Clyburn would make the national disgrace that currently inhabits the White House, king, if he could.

Clyburn and company belong behind bars along with Reid, Holder Obama and Pelosi, etc.

Just where in that teeny, tiny, little brain of his does Clyburn equate civil rights with fiscal (ir)responsiblity.

    Blacks=redistribution=higher taxes=more spending=raising the debt ceiling????

If Obama can do whatever he wants, what do we need Clyburn for?

Is Clyburn aware that the 13th Amendment actually freed the slaves? (not the 14th)

Isn’t it funny that government saw a need to enact a ban on slavery, even after the Emancipation Proclamation?

Why is that? Because an Executive Order may be a declaration of intent, but it cannot create a permanent legal state. That requires a law.

“He could do that [an executive order] with a stroke of a pen. We have seen many big things done in history that way,” Clyburn said

Yes, we’ve seen many ‘big things done in history’ by dictatorial fiat. Most of them horrifying.

after re-reading the 14 amendment 3 times, i don’t see where it says the president can by-pass congress and do what he wants by executive order.

Why would Clyborn say this, when Carney says they are “winning” the debate? Maybe they use the Charlie Sheen definition of “winning”.

An executive order does not make law. It merely declares publicly, to prosecute the existing laws in a certain way.

The 14th Amendment even stipulate that it is LAW that must be prosecuted, no matter what the government does: “Section 4. The validity of the public debt of the United States, AUTHORIZED BY LAW, including debts incurred for….”

Section 5 (mentioned above) only confirms this: “Section 5. The CONGRESS SHALL HAVE THE POWER, by appropriate legislation, the provisions of this article.”

    @ Liberal Trolls

If Congress has the exclusive power to make laws, then how can a president Veto anything.

Doesn’t a Veto give Legislative power to the Executive branch in violation of the Separation of Powers doctrine?

Remember Nancy carrying that gavel across the bridge flanked by dumbass CBC crooks? She was trying to recreate some civil rights scene from the past. Noboby bought it and nobody’s buying this stupid Clyburn stuff either. One silver lining about the Obama administration is that the race card and the PC crap is fading away. Now it’s just bums insisting on free stuff.

Thomas Jefferson warned, “To preserve independence … we must not let our rulers load us with perpetual debt. We must make our election between economy and Liberty, or profusion and servitude. … The fore horse of this frightful team is public debt. Taxation follows that, and in its turn wretchedness and oppression.”

How would such an executive order be enforced?

    ———-

    http://en.wikipedia.org/wiki/Executive_order#Legal_conflicts

Congress may overturn an executive order by passing legislation in conflict with it or by refusing to approve funding to enforce it.

Like I’ve said plenty of times before:

LET OBAMA INVOKE the 14th AMENDMENT!

I would like to know how he would due to the fact that HE DOES NOT HAVE THE POWER in the 14th Amendment. That power is granted by CONGRESS.

SECONDLY, the 14 amendment states that it gives the U.S. government the ability to NOT pay debts to those who have been recognized as combatant to the United States.

….(Please tell us again Mr. Obama about your close relationship and mentor BILL AYERS!) Get my drift?

I simply don’t understand how democrats are continued to be allowed to rewrite history and insist that they have been the champions of all civil rights all along while the evil racist republicans have stood in the way of it. Unfortunately for them, the truth is the exact opposite. Fortunately for them, most of our citizens are not well versed in our own history, and will fall for their lies and misrepresentations without fail. Sigh.
