Clinton-Appointed Federal Judge Blocks Kansas Law Defunding Planned Parenthood…
Another liberal activist judge aborts the 10th Amendment.

(AP) — A federal judge on Monday blocked implementation of a new Kansas law that would strip federal family planning funding from the state’s Planned Parenthood chapter, dealing Republican lawmakers their second major legal setback to their recent moves against abortion providers.
U.S. District Judge J. Thomas Marten ordered the state to immediately resume funding for Planned Parenthood, agreeing with Planned Parenthood that without the injunction the group would suffer irreparable harm while its challenge to the law works its way through the courts.
Planned Parenthood said it would be forced to close its clinic in the western Kansas city of Hays unless the court immediately prohibited the state from stripping it of $330,000 in federal Title X annual funding. It contended that its 5,700 patients would also face higher costs and have less access to services and longer wait or travel times for appointments.
The group is suing to block a budget provision that requires federal family planning dollars granted to the state by the federal government to go first to public health departments and hospitals. It leaves no money for Planned Parenthood and similar groups.

I love the “family planning” meme.
Plan my family by making an appointment to have my innards vacuumed after unprotected passionate humping with some guy.
Now that’s planning you can choose!
The Left seems to have no trouble finding SOME judge,
SOMEWHERE to rule in their favor. A death or retirement
in SCOTUS in the next year will grease the wheels on
the Progressive Train for eternity.
Planning = Murder.
Funny how every time a federal judge overturns something it is a Slick Willie appointee who does it!
Once again, I am having difficulty finding where in the constitution that it says that ANY judge can dictate what a state must or must not pay for.
What’s the point of having a legislature if unelected judges control government expenditures?
What happens if Kansas just ignores the Federal ruling? anyone know?
If the Fed Court won’t step in, who will kill the babies?
State of Kansas should ignore this court and force the feds to litigate the State which will push it up the court ladder until SOMEONE ( i’m hoping the SOTUS) will require a Constitutional reason for a Federal judge to invade in a 10th Amendment issue.
Oposition sign for anti family planning funding demonstration
“keep your slutty legs closed and save my tax dollars ya skank”
More reasons why judges should have term limits and be romved aftera certian number of years
Ignore that Federal Judge. Obama did it on the oil drilling deal. If it’s good enough for him, why not?
It is only an injunction while the lawsuit goes through. He did not overturn the the law stopping funding. Calm down.
Also, it is federal funding thus it is not a 10th Amendment issue.
All lying politicians should be subjected to “family planning” retroactively — seems if they were born and allowed to live, they should allow the same courtesy
to the next generations. If not, well, too bad their favorite physician (Dr. Kevorkian) set such a bad example himself.
Odd, we have a party devoted to perpetrators, perverts, jihadists and racists
— and the GOP “elites(?)” want to help them every time!
No debt increase!
Is Planned Parenthood a federal program or an independent “medical” provider?
I always thought it was a private business. So why the hell do we have to pay for it? And how do I get in on that kinda deal? Your taxes supporting my business…win for me!!
I have no problem with women’s health clinics that provide breast exams, gynecologic exams, etc.
But why should I have to pay so that these women can have sex without conceiving? Why shouldn’t they pay for their birth control themselves without a subsidy?
But why should I have to pay so that these women can have sex without conceiving?
-To balance out that viagra is covered by most healthcare plans?
@ rupaula
the fed judge ‘blocked implementation of a new Kansas law that would strip federal family planning funding’
just because it is federal funding doesn’t mean it trumps Kansas Law in the State of Kansas. 10th Amendment.
the fed can’t trump state law unless it involves an article of the Constitution that specifically gives that power to the fed.
@NoBlahBlah,
As a card carrying Federalist Society member, I’m pretty sure that Title X falls under the power to spend for the public good, it affects interstate commerce, etc. so yeah, the feds probably do have some say where that money goes. Ain’t sayin’ it’s a good thing, just saying how it is.
However, that is not what happened. The judge just issued an injunction while the case carries on because PP would be harmed if it is implemented. Would you be opposed to a judge issuing an injunction to allow a factory to continue during a lawsuit over new EPA regs? How about a bank continuing business if the state makes new regs affecting its business?
Yet, they appose killing of criminals who kill people multiple times. Ironic aint it..
If you agree with abortions, Ill pay for you to get fixed, that way you don’t kill anymore, just destroy your own life and not some innocent life. Your a Murder, and I have a wife and 2 daughters….yes its been discussed, your committing murder anyway you slice it….and they don’t agree with me. Your still a murder.
What the hell does the phrase “Don’t Cut Family Planning” actually mean? How much tax payer money does is take to “plan” a family? Why is our government involved in planning parenthood?
We are being raised like sheep and we are being fleeced like sheep.
@rupaula
okay no problem, let’s get in the weeds on this one, there is a lot of confusion
however in order to try to construct something that is short enough for this venue, some shortcuts will be taken and it will be up to those interested to fill in the blanks with their own study
Title X authority rests with HHS
http://www.hhs.gov/opa/familyplanning/grantees/index.html
these grants are distributed to the states to be awarded to ‘approved’ providers
Section 1001 – Family Planning Services
Specifically lists abortion as a non provided service of Family Planning
“The broad range of services does not include abortion as a method of family planning”
Kansas and the other states that have enacted legislation regarding this issue object to Planned Parenthood to name a name from ‘Mingling’ federal grant money awarded to them by the State of Kansas with the Family Planning grant at locations where they perform abortions due to the impracticality of separating out the funds which are also being used to support abortions indirectly by covering operating costs and other related expenses for Planned Parenthood and other abortion providers.
The legislation doesn’t take Title X grants away from Planned Parenthood, it simply restates the Law, that abortions cannot be used with Federal Grant money.
http://www.factcheck.org/2011/04/planned-parenthood/
“Its 2011 fact sheet says it performed 332,278 abortion procedures in 2009. That would mean that roughly one out of every 10 clients received an abortion.”
Planned Parenthood in their 2009 release stat’s State that 1 out of 10 ‘clients’ receive an abortion. It doesn’t take much grey matter to realize that the costs of performing an abortion per ‘client’ likely far outweigh the cost of a pap smear or handing out condoms or birth control pills.
So despite their protestations that abortions aren’t a big proportion of the total Scope of their Services, they doth protest too much, methinks
the legislation doesn’t take title X away from PP, Unless they fail to show that the funds are not co-mingled
sorry about the mistake
“It doesn’t take much grey matter to realize that the costs of performing an abortion per ‘client’ likely far outweigh the cost of a pap smear or handing out condoms or birth control pills.”
It takes even less grey matter to understand that defunding planned parenthood will result in fewer condoms and pills distributed.
It takes even less grey matter to understand that less assistance in planning NON parenthood as a result will result in more unwanted pregnancies.
More unwanted pregnancies = MORE ABORTIONS! YAAAAY!!! KS WANTS MORE ABORTIONS!!!
Congratulations dumbasses! Together we can ALL LOSE with your ASS BACKWARDS MEDIEVAL KANSAS WAYS! Here in NY I know many people who moved the **** out of your ass-backwards state, mostly from Salina. You couldn’t PAY them to go back. The horror… THE HORROR!!!
