Clinton-Appointed Federal Judge Blocks Kansas Law Defunding Planned Parenthood…

Another liberal activist judge aborts the 10th Amendment.

WICHITA, Kan. (AP) — A federal judge on Monday blocked implementation of a new Kansas law that would strip federal family planning funding from the state’s Planned Parenthood chapter, dealing Republican lawmakers their second major legal setback to their recent moves against abortion providers.

U.S. District Judge J. Thomas Marten ordered the state to immediately resume funding for Planned Parenthood, agreeing with Planned Parenthood that without the injunction the group would suffer irreparable harm while its challenge to the law works its way through the courts.

Planned Parenthood said it would be forced to close its clinic in the western Kansas city of Hays unless the court immediately prohibited the state from stripping it of $330,000 in federal Title X annual funding. It contended that its 5,700 patients would also face higher costs and have less access to services and longer wait or travel times for appointments.

The group is suing to block a budget provision that requires federal family planning dollars granted to the state by the federal government to go first to public health departments and hospitals. It leaves no money for Planned Parenthood and similar groups.

    Once again, I am having difficulty finding where in the constitution that it says that ANY judge can dictate what a state must or must not pay for.

    What’s the point of having a legislature if unelected judges control government expenditures?

    If the Fed Court won’t step in, who will kill the babies?

    State of Kansas should ignore this court and force the feds to litigate the State which will push it up the court ladder until SOMEONE ( i’m hoping the SOTUS) will require a Constitutional reason for a Federal judge to invade in a 10th Amendment issue.

    It is only an injunction while the lawsuit goes through. He did not overturn the the law stopping funding. Calm down.

    Also, it is federal funding thus it is not a 10th Amendment issue.

    All lying politicians should be subjected to “family planning” retroactively — seems if they were born and allowed to live, they should allow the same courtesy
    to the next generations. If not, well, too bad their favorite physician (Dr. Kevorkian) set such a bad example himself.

    Odd, we have a party devoted to perpetrators, perverts, jihadists and racists
    — and the GOP “elites(?)” want to help them every time!

    I have no problem with women’s health clinics that provide breast exams, gynecologic exams, etc.

    But why should I have to pay so that these women can have sex without conceiving? Why shouldn’t they pay for their birth control themselves without a subsidy?

    just because it is federal funding doesn’t mean it trumps Kansas Law in the State of Kansas. 10th Amendment.

    the fed can’t trump state law unless it involves an article of the Constitution that specifically gives that power to the fed.

    As a card carrying Federalist Society member, I’m pretty sure that Title X falls under the power to spend for the public good, it affects interstate commerce, etc. so yeah, the feds probably do have some say where that money goes. Ain’t sayin’ it’s a good thing, just saying how it is.

    However, that is not what happened. The judge just issued an injunction while the case carries on because PP would be harmed if it is implemented. Would you be opposed to a judge issuing an injunction to allow a factory to continue during a lawsuit over new EPA regs? How about a bank continuing business if the state makes new regs affecting its business?

    however in order to try to construct something that is short enough for this venue, some shortcuts will be taken and it will be up to those interested to fill in the blanks with their own study

    Section 1001 – Family Planning Services
    Specifically lists abortion as a non provided service of Family Planning
    “The broad range of services does not include abortion as a method of family planning”

    Kansas and the other states that have enacted legislation regarding this issue object to Planned Parenthood to name a name from ‘Mingling’ federal grant money awarded to them by the State of Kansas with the Family Planning grant at locations where they perform abortions due to the impracticality of separating out the funds which are also being used to support abortions indirectly by covering operating costs and other related expenses for Planned Parenthood and other abortion providers.

    The legislation doesn’t take Title X grants away from Planned Parenthood, it simply restates the Law, that abortions cannot be used with Federal Grant money.

    It takes even less grey matter to understand that defunding planned parenthood will result in fewer condoms and pills distributed.
