Obama’s Job Bill Will Make The Unemployed a Protected Class, Allows Job-Seekers To Sue For Discrimination…

This has nothing to do with “protecting” the unemployed and everything to do with giving the trial lawyers lobby a big wet kiss.

(The Hill) — President Obama’s American Jobs Act, which he presented to Congress on Monday, would make it illegal for employers to run advertisements saying that they will not consider unemployed workers, or to refuse to consider or hire people because they are unemployed.

The proposed language is found in a section of the bill titled “Prohibition of Discrimination in Employment on the Basis of an Individual’s Status as Unemployed.” That section would also make it illegal for employers to request that employment agencies take into account a person’s unemployed status.

It would also allow aggrieved job-seekers to seek damages if they have been discriminated against. This provision in particular prompted Rep. Louie Gohmert (R-Texas) to argue that Obama’s proposal is aimed at creating a new, special class of people who can sue companies.

“So if you’re unemployed, and you go to apply for a job and you’re not hired for that job, see a lawyer,” Gohmert said on the House floor. “You might be able to file a claim because you got discriminated against because you’re unemployed.”

He said this provision would only discourage companies from interviewing unemployed candidates, and would “help trial lawyers who are not having enough work,” since there are about 14 million unemployed Americans.

Under the bill, companies saying they will not consider unemployed candidates could face a court order enjoining them from this practice, a fine of up to $1,000 per day or “reasonable attorney’s fees.” Other violations could lead to damages as high as $5,000.

    The only problem with your reasonable question, is that the Company will have to go to court (with their lawyers) to prove they didn’t discriminate.

    It will cost them a lot of money and time. Multiply that times about 1,000. And you’ll find that they’ll end up paying people a settlement just to get out of their hair. And then they’ll stop taking any new applications at all!

    So, Obama’s little gift to the trial lawyers will actually cause employers to be less likely to create new job openings!

    This bill would become a major victory for India!

    If this becomes law, the only way an employer can avoid being sued is to hire a h1-b replacement-worker from India. Tata has the capacity to send 10 million replacement workers here as fast as the transportation can move them.

    Likewise, employers will gain a strong incentive to hire Mexican Nationals.

    I’m sorry, but does anybody do that? As far as I’ve ever been able to tell, I can ONLY get a job when I’m unemployed. When I have a job and apply for another, I have zero luck.

    I mean, does this really need a law? Is it common for people to take out ads that say “no dogs/Irish/unemployed’ or something? I’ve never seen it.

    T2M, that’s supposedly what the law is designed to prevent. So if a company even hires anyone in the US at all, they are vulnerable. Even Bart Roberts scenario will leave them vulnerable, because they COULD HAVE hired someone unemployed here.

    The only solution is to ONLY create jobs overseas.

    If they want to get companies to hire the unemployed, give them a break on the unemployment taxes for those unemployed actually hired. Save money from the unemployment fund by taking people off the rolls, and you get to keep some money yourself.
    But this makes too much sense for democrats.

    In a democracy, all people are supposed to have equal say in the decisions made by their government. Therefore, the majority vote should be the one chosen while making major decisions, such as electing the President. One thing that may throw equality off-balance is the social class of the people. Social classes range from numerous poor to middle class (and even the “rich”) citizens, all the way to the super rich, who pretty much control 2/3 of America’s net worth. As a result, it is very hard to believe that the entire country considers these people equal.
    One specific example of how the super rich have more power than the lower classes is how they vote. Out of the ten richest members of congress, all ten voted to extend the bush tax cuts (Gilson & Perot, http://motherjones.com/politics/2011/02/income-inequality-in-america-chart-graph). These extremely wealthy people had the power to save themselves some money, and they did it without hesitation. Meanwhile, the average working Americans were stuck with their same salaries and tax rates.
