Federal Judge Rules California School Can Ban Students From Wearing American Flag Shirts During Cinco de Mayo…
Absurd.
(Fox News/Todd Starnes) — A federal court has ruled that a California public school had the authority to prevent students from wearing clothing emblazoned with pro-American messages on the Mexican holiday Cinco de Mayo.
U. S. District Court Judge James Ware was ruling in a case involving students at Live Oak High School in Morgan Hill, CA, who were banned from wearing American flag t-shirts on the Mexican holiday in 2010.
The judge determined that the Morgan Hill Unified School District did not violate the First Amendment and said that concerns by school officials over possible violence justified censoring the pro-American message.
“The school officials reasonable forecast that Plaintiff’s clothing could cause a substantial disruption with school activities, and therefore did not violate the standard set forth — by requiring that Plaintiff’s change,” the judge wrote.

Last I checked Cinco De Mayo was a “Mexican Holiday” I believe Mexico is not part of the United States. When Mexico starts paying taxes in the U.S. then maybe we will recognize them.

The judge and the school district show the racism of low expectations. They assume Mexican students will react violently to the flag of their adopted country. And, if they do react violently they should be sent back to Mexico .

On June 27, 1997, President Bill Clinton nominated Ware to a seat on the United States Court of Appeals for the Ninth Circuit, to replace J. Clifford Wallace, who had taken senior status. Ware had a hearing before the U.S. Senate Judiciary Committee in October 1997.
However, Ware’s nomination unraveled amid an embarrassing scandal that ultimately resulted in a judicial reprimand, and Clinton withdrew his nomination of Ware on November 27, 1997. In 1998, Judge Ware was reprimanded by the Judicial Council of the Northern District Court of California for fabricating the story of being the brother of Virgil Ware, a 13 year old black boy shot by white teenagers in Alabama in 1963 on the same day as the 16th Street Baptist Church bombing. According to a story Judge Ware had told many audiences, he was riding his bike with his brother Virgil on the handlebars when Virgil was shot and killed by white racists. The incident was a real one, however it happened to a different James Ware, as was discovered when Judge Ware’s claim was published in the Alabama papers after he was nominated to the Ninth Circuit by President Bill Clinton. The father of the long-ago slain boy contacted the Alabama courts to report that the California judge was impersonating his own son James Ware who was an employee in a Birmingham power plant. The Alabama courts contacted the California courts, who convened the ethics hearing. Judge Ware was reprimanded but allowed to retain his lifetime appointment as district judge.

Last time I checked trampling and desecrating a flag was strongly protected First Amendment speech that could not be stopped for things like outrage or hurt feelings. I do believe if they are not allowed to wear the Stars and Stripes perhaps it is time to exercise their First Amendment rights and set about desecrating a Mexican flag instead. After all we wouldn’t want to deny anyone their rights to artistic expression or free speech now would we, that would be simply barbaric.
IF I were the parent of one of these students, I would not only dress him/her in the American flag, I would do as well and accompany my child to school. Parents have to teach their children what a rightful protest is, or they’ll wind up as OWS reps. YES, it is right to protest ignorance and rebellion and stupidity. If they/we don’t, we’re stuck with the present situation.

Unless the Judge rules that the Mexicans are not permitted to wear shirts of their particular favor, this ruling shows blatant bias. Activist judges need to be removed.
So then the reverse must hold – if Americans are offended by Mexican flags or celebrations then they cant’ wear them to school either. The American flag must never be banned. The parents of the school should sue the district – keep suing these public schools and the gov’t until they run dry and stop with the restrictions on freedom of speech. It is unconstitutional. There is no excuse for limiting speech because someone else is offended. NO excuse. Our rights are being taken away. American taxpayers pay for this school. Imagine a Mexican school banning their own flag? Never happen.

My homeschooled daughter could tell you that Cinco de Mayo honors the 1862 victory of the Mexicans over the French at the Battle of Puebla. The French had landed at Veracruz to collect on loans they had made to Mexico, but being broke, Mexico had temporarily suspended loan payments to foreign governments. Outraged, 8,000 French soldiers marched on Mexico City but were soundly defeated at Puebla by a force of only 4,000 Mexicans. This victory was responsible for a surge in Mexican pride.
Interestingly, the next year, the French returned with 30,000 troops and DID take Mexico City. Mexico remained under French control until 1867, when the U.S. helped Mexico expel the French.

My job requires me to call doctors’ offices and hospitals all over the United States. You would not believe how many New England and Midwest states now have automated phone systems that begin, “Press 1 for English. Para espanol, oprima numero dos,” or the like. So the court is making a soft racist decision (as has been done time and again with Islam). Namely, they are saying that since Mexican students won’t be able to control their violent natures on seeing an American flag on a Mexican holiday (mind you, a holiday that the Mexican students wouldn’t even care about if white America didn’t tell them it existed through Corona commercials), the patriotic shirts must be banned. Mexicans will act violently if provoked because that’s how they are, so you are banned from doing anything that might slightly provoke them.

SignPainterGuy is right and as Kat has explained the significance of that day – the victory of Mexico over the French at the Battle of Pueblo, it is a historical event but not a celebrated holiday in Mexico though it is now beginning to be because of its emphasis by America. I dated a man several years ago from Michoacan, MX who had never heard of celebrating Cinco de Mayo until he came here. It’s been a great promo though and we have drunk many a Corona to honor it.
Circo de mayo is remembering the streets flowing with blood like rivers, in Puebla, standing their ground. the judges new favorite mexican dish should be beef brain massacre style with Puebla sauce, since he wants to stick his nose in others peoples business.
This judge just made things tougher for us Hispanics. Part of the US population already wants to genocide us, now this will just give ammo to the Nativists and whip up anti-Hispanic feeling in America. This in turn will drive more Hispanics into the arms of La Raza.

I have no problem with the American flag shirts being disallowed. It is a statement of disrespect to wear the American Flag as clothing. In the name of patriotism, the flag is frequently shown in ways that are counter indicated by the the Flag Code of the United States. The American Flag should be displayed at all times in a manner that is respectful of it. The American Flag is not to worn as an article of clothing. or displayed in such a manner that is inappropriate. I am really tired of seeing the Flag on clothing, pasted on windows, or flown until it is ragged. That is what is disrespectful.
Red, white and blue in some form should become the school uniform of the day as others here have suggested.
