Obama Escalates Appointments Crisis, Claims Cordray Has Full Powers Without Senate Approval…

Via Daily Caller:

President Barack Obama today escalated his claimed power to appoint top officials by announcing that his financial-sector appointee also has authority that is legally reserved only for an official who has been confirmed by the Senate.

The 2010 law that established the Consumer Financial Protection Bureau includes a section that says many of the bureau’s new powers are to be held by the secretary of the Treasury “until the Director of the Bureau is confirmed by the Senate.”

Obam’s Jan. 3. claim to have appointed Cordray appears to violate the Constitution and is a grab for increased presidential power, say many constitutional lawyers.

But his new Jan. 6 claim about Cordray’s powers goes even further by contradicting the plain language of the 2010 law that created the bureau.

Section 1066 of the law says many of the bureau’s new powers are activated once the Senate confirms a director. Those extra powers include the authority to write regulations for non-bank firms, such as payday lenders.

    There are very few things that can be done oddly enough. Prior to 1923 a writ of quo warranto and a writ of mandamus could have been filed but SCOTUS scuttled that route and vitiated the All Writs Act. Congress cannot defund the agency because they don’t fund it – this agency tells the Fed how much money it needs and gets it.

    When a rule is issued by this outfit or the NLRB any affected entity can sue to block it based on the appointment and the statutory language, but until then not much can happen.

    Question for both of you, how do you suppose this new CFPB will “deal” with the military? This article really isn’t the particular one I had in mind, couldn’t locate what I was thinking of. However, have heard of military being “bombarded” with “goofy” banking issues of one type or another. Do you suppose it’s possible something was created and then voila a nice solution created after that?

    Would like to hear what either or both of you know on this regard. Thanks.

    It’s questionable whether a Senate-approved candidate would have this power. Congress is not allowed to delegate it’s ‘rule-making’ authority to another branch of government. It only stands to reason that those powers couldn’t be acquired through theft either.

    Frankly, at this point I’m pretty much convinced that Obama is doing everything he can to PROVOKE impeachment hearings, so that he can play the victim card. He owns the Senate, which would decide the matter, so he’s safe that way, and since he owns around 80% of the media, he probably believes that he is in a win-win situation. The Republicans can try to impeach, giving him the victim card to play, or they stay back, and allow him to do whatever he wants while Tingles Matthews and the rest of his ilk carry his propaganda water jug for him.

    @Hickster – The U.S. Army has Army Community Services (ACS) that offers financial counseling and same service as the CFPB. When the mortgage crisis hits, numerous lenders were ignoring the Service Members Civil Relief Act and ACS stepped in while the current administration stood on the sidelines.
